Chiropractor's trial on fondling charges to begin
The trial for a Gillette chiropractor accused of fondling some of his patients begins at 9 a.m. Wednesday in District Court in Gillette.
Jack Faubion, 32, is charged with five counts of third-degree sexual assault. He is accused of fondling the breasts of five women patients between 2004 and 2006.
The case will not be decided by a jury but by retired District Judge John C. Brackley of Sheridan, who has been brought in for the bench trial. The bench trial was requested by Faubion’s attorney, Nick Carter.
It is scheduled to last two to three days.
The trial has been delayed several times since Faubion was bound over to District Court more than a year ago. Gillette Police began investigating the allegations in November 2006 after a woman had gone to see Faubion for treatment for a back injury.
According to court documents, Faubion began to fondle her breasts during the examination, saying that he was trying to see if she had a rib out.
After her 45-minute appointment, she contacted other chiropractors, who told her that the treatment wasn’t appropriate, according to court documents.
